TUCSON, Ariz. (13 News) – On May 13, the Pima County Department of Environmental Quality served Ames Construction with a Notice of Violation for violating its fugitive dust permit.

Ames Construction was hired by Beale Infrastructure to help build the data center, Project Blue.
The citation came after inspections of the Project Blue worksite on May 8 and 11.
The County inspector said Ames failed to use proper dust mitigation practices which resulted in visible dust emissions.

PCDEQ said Ames has until May 17 to respond to the notice, must immediately comply, and must have water onsite to help mitigate the dust.

State law allows for fines up to $10,000 a day, per violation of the permit.
This citation comes following other controversies with the Project Blue site.
Most recently, the City of Tucson cut off the site’s water supply, claiming the Project Blue subcontractor had been misusing it.
The city has been vocal about not wanting anything to do with the data center, and it has been largely opposed by the public.
