TUCSON, Ariz. (13 News) – The suspect in a vigilante case from 2025 has been found guilty.

On June 12, the jury convicted Andrew Anaya of reckless manslaughter.
Anaya stood trial on June 8 for a November 2025 incident.
The Pima County Attorney’s Office said Anaya confronted the victim, Emery Kirk, who was trying to steal cigarettes from a local gas station.
During the confrontation, Kirk was knocked unconscious and later died from his injuries.
“Today’s jury verdict confirms that we will not tolerate vigilante behavior and sudden outbursts of violence,” Pima County Attorney Laura Conover said.
Anaya will face sentencing in the coming weeks.

The Tucson Police Department is investigating the death of a man at a convenience store.
The TPD says officers responded to the store located at 4160 North First Avenue on Friday, Nov. 21.
Police say 46-year-old Emery Kirk was found unresponsive and taken to Banner University Medical Center in critical condition.

He died the next day.
The TPD says officers learned Kirk entered the store, went behind the counter, and started concealing packs of cigarettes from a shelf.
Police say a bystander intervened and a physical confrontation occurred between the two.
The 31-year-old male involved in the confrontation called 911 to report the incident.
The investigation has been turned over to the Homicide Unit for further review.
Evidence at the scene has been collected, and all parties involved have been identified.
No arrests have been made at this time, and the case will be presented to the Pima County Attorney’s Office for review.
