Phoenix police officers responded to the Acero North Valley apartments near Dove Valley Road and North Valley Parkway around 12:30 a.m. Tuesday for a reported shooting.

When officers got to the scene, they made announcements for those inside to exit a unit, which is when 28-year-old Joseph Gabriel Peixotto came outside. He was taken into custody at the scene.

Police then went into the unit and found a man, later identified as 50-year-old Joseph Elmer Peixotto, dead from a gunshot wound in the chest.

Detectives came to the scene to investigate the homicide. According to Phoenix Police, the investigation found that the two men, who were father and son, were arguing before the younger Peixotto shot his father. Court documents state a roommate was the one who called 911.

Court documents state Peixotto was heard in the background of the 911 call stating that his father “was going to assault him.”

Investigators found a black semi-automatic pistol in a holster on the kitchen counter while searching the apartment. Two casings, one next to the victim’s foot and the other in the bathroom, were also found.

Investigators interviewed both Peixotto and the roommate. The roommate said he had recently moved back into the apartment and had just come back from vacation the evening of the shooting.

The roommate reportedly said that Joseph Gabriel showed up to get some of his belongings, which were in the roommate’s bedroom. Court documents say the younger Peixotto told the roommate that his father was kicking him out of the apartment.

Court documents state the witness reported hearing the father and son arguing and heard the older Peixotto ask, “What, you gonna shoot me?” The roommate heard two gunshots and saw the victim fall to the ground.

The roommate asked Peixotto why he shot his father, to which he claimed that his father was “going to beat my ass,” court paperwork details.

Joseph Gabriel Peixotto refused to speak to investigators and requested an attorney. He was booked on one count of second-degree murder and is being held on a $1 million bond.
