TUCSON, Ariz. (13 News) – The man found guilty in the Tucson vigilante case has been sentenced.
On Friday, Sept. 11, Andrew Anaya was sentenced to six months in jail and probation for four years. He was also ordered to pay $212 in restitution.
Anaya will have a status hearing at 9 a.m. on Sept. 23 to set a schedule for serving his jail time.
On June 12, a jury found Anaya guilty of reckless manslaughter.
The Tucson Police Department said Anaya got into a fight with Emery Kirk at the Circle K at North 1st Avenue and East Limberlost Drive on Nov. 21, 2025. The 46-year-old Kirk died days later from his injuries.
The TPD said Kirk went into the gas station store and tried to steal cigarettes. Anaya tried to stop him and eventually knocked Kirk unconscious.
“Today’s jury verdict confirms that we will not tolerate vigilante behavior and sudden outbursts of violence,” Pima County Attorney Laura Conover said.

According to the autopsy report, Kirk suffered blunt force injuries that included skull fractures and brain hemorrhages. He also had skin abrasions, contusions, and lacerations. The cause of death was blunt force trauma, while the manner of death was homicide.
Kirk had amphetamine and fentanyl in his system, according to the toxicology report.
