What police records say
A grand jury indicted Hoopes on charges of second-degree murder and unlawful discharge of a firearm. The docket records a not guilty plea in the case.
According to Tempe police records, Hoopes told an officer he woke up startled, took a handgun from his nightstand and fired toward the bed before realizing he had shot his wife. Police records say Colleen Hoopes was taken to a hospital, where she died.
A police report’s summary of the autopsy says she suffered one gunshot wound that entered near the base of her neck and exited her upper back.

Hoopes’ attorneys argued in a 2022 motion that the shooting was an accident and asked the court to send the case back to a grand jury, alleging prosecutors presented misleading information and did not provide relevant legal instructions. The defense made those claims in the motion.
The court records provided do not establish whether the Nov. 16 hearing will result in a plea change or whether the case will proceed to trial.
