TUCSON, Ariz. (13 News) – A Border Patrol agent and a University of Arizona student have been accused of filming the sexual assault of an intoxicated woman at a home in Sahuarita.

Zabdiel Echie made his first court appearance in Pima County on Wednesday, Sept. 2, and is facing one count of sexual assault and one count of kidnapping. The 24-year-old Echie, of Sahuarita, was released after posting a $150,000 bond.
Joaquin Borboa made his first court appearance in Pima County on Thursday, Sept. 3. The court waived the reading of charges, and 13 News has requested the interim complaint to find out the charges he is facing. The 21-year-old Borboa, of Tucson, was being held on a $350,000 bond.
During Echie’s court appearance, which can be seen in the player above, his attorney said Echie is a Border Patrol agent. The judge said if he is released, he cannot contact the victim or possess a firearm.
13 News has reached out to CBP for a statement and update on Echie’s employment.
The Sahuarita Police Department, which investigated the incident, confirmed that Borboa was arrested for the same June incident as Echie.
During Borboa’s court appearance, which can be seen in the player below, the state said the evidence on Borboa’s cell was much worse than the video found on Echie’s phone.
According to his appearance, Borboa is a student at the University of Arizona and allegedly played soccer at Pusch Ridge High in Tucson.
Both men have preliminary hearings set for Sept. 14.
According to the interim complaint for Echie, the victim said that Echie and Borboa drove to Tucson to pick her up.
During the drive to Sahuarita, Echie allegedly gave her alcohol and an “unknown white powdery substance.”
The victim said her memory became impaired, her teeth felt numb, she was dizzy, and that she experienced spotty memory and altered consciousness.

The victim said she was given more alcohol at the home and that Echie called her “baby” and began rubbing her thighs. She said she asked Echie what he was doing before passing out.
The victim said she later woke up naked in Echie’s bed with him having sex with her. She said she tried to push him off, but he was too heavy, and that he and Borboa held her down.
The woman told investigators she was in and out of consciousness but heard Echie and Borboa joking and laughing about rape.
The victim said she thinks the encounter was recorded because she saw a “camera, light and lens in the room.”
According to the interim complaint, a 26-second video of the encounter was found on Echie’s cell.
Investigators said the victim could be heard crying during the incident, and Borboa could be seen holding the woman down while Echie had sex with her.
The SPD also said it found messages between Echie and Borboa discussing the incident.
