TUCSON, Ariz. (13 News) – The Tucson man sentenced to life in prison for a triple-fatal crash that happened during a human smuggling operation in Cochise County will likely get a new trial.

A state appeals court vacated the conviction of Erick Antonio Diliz, who was found guilty on three counts of first-degree murder, seven counts of aggravated assault, and one count of unlawful flight from law enforcement.
Authorities said the rollover happened while Diliz was transporting undocumented migrants on Interstate 10 in Cochise County in February 2023.
Arizona DPS said a trooper tried to pull Diliz over after realizing the truck he was driving had been reported stolen.
Diliz allegedly refused to stop and hit speeds up to 120 mph. Diliz crashed after driving over a spike strip laid down by a trooper.
Three people in the truck died, and five others were injured.
Diliz was injured, but was later interviewed by a detective at the hospital. The appeals court ruled that the testimony taken at the hospital and used in his trial violated his Miranda rights.

13 News has reached out to the Cochise County Attorney’s Office, which handled Diliz’s case. While the CCAO has not responded yet, it is likely due to the Labor Day holiday.
As of Monday, Sept. 7, the 44-year-old Diliz was still in custody at the Lewis Complex in Buckeye.
According to state records, Diliz was convicted of drug possession in Pima County in 2016 and was sentenced to two years in prison.
