According to a search warrant from the University of Arizona Police Department, the alleged sexual assault happened at the Sigma Phi Epsilon house, located at 1614 East 1st Street, either late Aug. 25 or early Aug. 26.

The alleged victim told investigators she was at the house with friends and at least two members of the fraternity.

She said she woke up in a bed in a dark room with no pants or underwear on. She said there were two men in the room, and they were having sex with her.

13 News talked with several University of Arizona students, and at least one said she really isn’t surprised.

“It sucks to see it happen, but I feel like in this day and time, it really can be anyone,” said Marla Brenner. “Anyone who seems normal can be a perpetrator like that.”

The victim told investigators she thought she told the men to “please stop,” but was later unsure. She said she does not remember touching either man, nor does she remember being asked for or giving consent.

She said she later woke back up in bed with one of the men, and both were naked. She said when the man woke up, she told him, “We have to go.” The two then walked together back to the victim’s sorority, which was down the street.

She said she called her mother when she got back to the sorority house and then fell back asleep.

She woke up around five hours later and reported the incident to the UAPD. She was taken to a local hospital for a sexual assault forensic exam. Results of the test supported some of the woman’s allegations.

Another U of A student, a member of a fraternity, said it falls on everyone to speak out against sexual violence.

“I feel like it’s important for Greek organizations to also speak up and show support for the safety on campus,” said Jairo Flores. “Speaking out against sexual violence, domestic violence, and all of that. (it) occurs, and often goes silent.”

The victim later told investigators she had a tequila soda, two shots of tequila, and shared a cup of tequila with friends that night.

On Aug. 28, the woman talked with the man who had walked her back to her sorority. The man admitted the two had sex, but said there was not another man there.

The man said that he was drunk that night and was “fuzzy” about what happened.

He also said the woman said yes to having sex, and he also admitted he told other people the two had sex.

“At the end of the day, I just hope the U of A continues to not just do the classic (slap)on the wrist, but also genuinely cares for the women, but genuinely the student body,” said student Josie Shivers.

He said the two were hanging out all night, drinking, dancing, and wrestling. Witnesses said they saw the two together throughout the night.

The victim said she had a bruise on her throat and had difficulty swallowing. The man allegedly told her, “That was him.” A test at the hospital showed possible signs of strangulation.

13 News reached out to the university, the UAPD, the local Sigma Phi Epsilon chapter, and the national fraternity for comment.

The U of A and the UAPD both said they cannot comment on an active investigation.

Sigma Phi Epsilon’s national office released the following statement.

Sigma Phi Epsilon takes the reported incident involving a member of its University of Arizona chapter seriously. We expect members to cooperate fully with any investigation. The safety and well-being of members, guests and the broader campus community are central to our expectations for every member.

Sexual misconduct has no place in SigEp and is fundamentally incompatible with our values of Virtue, Diligence and Brotherly Love. Any member found to have violated the Fraternity’s standards will be subject to appropriate accountability, up to and including expulsion.

Our concern is with those affected. We remain committed to supporting a safe campus community.

In May 2026, the U of A chapter of Sigma Phi Epsilon was placed on probation for a year.

The move by the Dean of Students Office came after the fraternity was accused of hazing. The allegations include sleep deprivation, forced alcohol consumption, kidnapping, and forced calisthenics. Members were also accused of illegal drug use.

In addition to the probation, the fraternity was also ordered to attend a hazing workshop, do a review of its members, meet monthly with the national charter, and pay a fine of nearly $4,000.

It is unclear if that probation includes having visitors and alcohol at the house.
