The Gila County Attorney’s Office said Friday in a letter that Alberto Ontiveros-Sanchez will not be prosecuted for punching Abel Uribe during Uribe’s sentencing hearing last week.

Ontiveros-Sanchez addressed the court at the podium Sept. 23 as part of the victim statements, where prosecutors said he “chose to bear his soul in open court.” When he walked back to his seat, prosecutors said Uribe mocked him.

Ontiveros-Sanchez’s attorney told a judge that Uribe was laughing after Ontiveros-Sanchez spoke, which upset Ontiveros-Sanchez. That was when Ontiveros-Sanchez punched Uribe four or five times.

The attorney’s office said Ontiveros-Sanchez is a victim who “has the right to be treated with respect and dignity through the processing of a criminal case” under the law.

“The conduct of Abel Guadalupe Uribe was so abhorrent that the obvious reaction of Mr. Sanchez, who was already in an emotionally fragile state, would be violence,” Gila County Attorney Bradley Beauchamp said in a letter to the Maricopa County Sheriff’s Office.

Beauchamp said justice would not be served if Ontiveros-Sanchez was prosecuted for his reaction.

Ontiveros-Sanchez was facing charges of aggravated assault of a bound or restrained victim, fighting and interfering with a judicial proceeding.

There were fears that Ontiveros-Sanchez, a permanent legal resident, could face immigration consequences if he was convicted of a felony.

Uribe was in court to be sentenced to life in prison for murdering David Navidad-Parra, a West Point graduate and Army veteran.
