LAS VEGAS (FOX5) \u2014 A daycare with multiple locations throughout the valley is at the center of a police investigation and now faces a lawsuit alleging negligence and assault of a child.<\/p>\n

Ricky and Yavonne Plair said their 4-year-old son Rich\u2019e was a student at Leap Into Learning on Russell Road when teachers allegedly tied him up. <\/p>\n

The parents said they pulled him out of the school after learning of the alleged incident.<\/p>\n

The couple told police their son was tied up at daycare on March 3. Yavonne said the director called her and said CPS was coming to the facility about an incident.<\/p>\n

\u201cShe was like well apparently a teacher tied Ricky up to a chair with his shirt, and another teacher recorded it and she put it online,\u201d Yavonne said.<\/p>\n

According to the Las Vegas Metropolitan Police report, the parents told police the daycare did not tell them about the alleged incident until after CPS got involved.<\/p>\n

Yavonne said Rich\u2019e tried to tell them that day.<\/p>\n

\u201cWhen I picked him up he said my teacher tied me up and I was like I thought he was joking I should have listen to my son I should have went in there and questioned at the time,\u201d she said.<\/p>\n

Rich\u2019e said he was tied up at a chair for \u201ca long time like two minutes.\u201d<\/p>\n

Police investigating as abuse and neglect case<\/h2>\n

The Metro police report confirm they are investigating this incident as an abuse and neglect case. Their records show they have a suspect and a person of interest, however as of this report neither are facing charges.<\/p>\n

The family has filed a lawsuit against the daycare.<\/p>\n

FOX5 Investigates: Parents sue daycare claiming son was tied up by FOX5 Vegas <\/p>\n<\/p><\/div>\n<\/div>\n

While Rich\u2019e described to FOX5 being tied to a chair, the lawsuit filed in Clark County District Court refers to the leg of a table and the police report said the leg of a chair. <\/p>\n

The family\u2019s attorneys said the video evidence once subpoenaed, will clarify exactly what happened.<\/p>\n

The suit also says the employee \u201cabused their position of authority and trust over Rich\u2019e, a vulnerable young child in their care\u201d and that he was humiliated in front of his peers.<\/p>\n

\u201cThe more reason I came down here is because I seen it before on TV about kids being tied up and being hurt by teachers and for it to happen on my own. It hit me,\u201d Ricky said.<\/p>\n

Leap Into Learning did not respond to multiple requests for comment. <\/p>\n

The person of interest and the suspect named in Metro\u2019s crime report both declined to speak.<\/p>\n
