TUCSON, Ariz. (13 News) – Charges have been dismissed against the DACA recipient detained by ICE at her Tucson home.<\/p>\n

Karla Toledo was scheduled to appear in front of an immigration judge this morning, June 3.<\/p>\n

The hearing never happened after a judge ruled Tuesday June 2 that the \u201dmatter dismissed without prejudice.”<\/p>\n

Karla Toledo\u2019s attorney told 13 News on Thursday that she could be released from the ICE detention center in Eloy once her $1,500 bond was posted.<\/p>\n

Rep. Adelita Grijalva said Toledo should never have been detained in the first place.<\/p>\n

\u201cKarla was brought to this country at just one year old, has active DACA status, and no criminal history,\u201d Grijalva said. \u201cShe has the critical job of helping recruit healthcare workers, pays her taxes, and gives back to our community serving on local boards and through volunteer work. She is the complete opposite of the \u2018worst of the worst\u2019 that Trump claimed he would prioritize.<\/p>\n

\u201cI can\u2019t even begin to imagine the trauma of being ripped from your home by masked agents. ICE has still failed to answer why agents entered her home without a warrant signed by a judge, or why they attempted to smear her name with unsubstantiated allegations about what occurred. The conduct of the agents during the arrest, along with ICE\u2019s handling of the incident afterward, raise deeply troubling questions about an agency that continues to act as if they are above the law. The agents involved must be investigated and held to account.\u201d<\/p>\n

Toledo was taken into custody by ICE at her home on Monday, May 18.<\/p>\n

Arizona lawmakers and local activists had been calling for her release, claiming Toledo was a DACA recipient, that her status was up to date, and that she had no criminal history.<\/p>\n

The Department of Homeland Security has said that isn\u2019t true.<\/p>\n

DHS said Toledo assaulted a federal agent who was trying to detain another person on Monday, and claimed Toledo was in the country illegally.<\/p>\n

\u201cOn May 18, ICE arrested Karla Toledo, an illegal alien from Mexico, during a targeted immigration enforcement operation near Tucson,\u201d DHS said in a release to 13 News. \u201cDuring the operation, Toledo assaulted a law enforcement officer\u2014a felony and crime \u2014 who was attempting to apprehend another individual.”<\/p>\n

DHS said that while Toledo applied for DACA, she entered the U.S. illegally on Oct. 12, 2024.<\/p>\n

\u201cAt the time of her arrest, ICE had an active warrant and a pending application for DACA (from Toledo). She will remain in ICE custody pending her removal proceedings,\u201d DHS said. \u201cIllegal aliens who claim to be recipients of DACA are not automatically protected from deportations. DACA does NOT confer any form of legal status in this country.\u201d<\/p>\n

Goldman denied and refuted ICE\u2019s claims.<\/p>\n

\u201cThere is surveillance footage that shows that Ms Toledo did not assault a DHS officer,\u201d Goldman said. \u201cShe did not assault a DHS officer; that was fabricated.\u201d<\/p>\n

Goldman said Toledo has lived in the United States since she was 1 year old. ICE claimed that Toledo\u2019s application for DACA was pending, and she will remain in custody for removal proceedings.<\/p>\n

\u201cShe\u2019s like tens of thousands of DACA applicants right now that have applications that are just sitting and pending with U.S. immigration,\u201d Goldman said.<\/p>\n

ICE also alleged Toledo had an active warrant for her arrest, but stopped short of identifying what the warrant entailed.<\/p>\n

Goldman and Toledo\u2019s family said that she was an active member of the community who knew her rights and asked the federal agents to present a warrant signed by a judge before agents entered her home.<\/p>\n

The family and lawyer claim that the agents never presented a warrant signed by a judge and went into the family\u2019s home.<\/p>\n

Arizona representative Adelita Grijalva questioned this too and released a video statement, which can be watched below, responding to ICE\u2019s allegations.<\/p>\n

In the video, she said, \u201c(ICE) has not answered why agents violently stormed Karla Toledo\u2019s home without a warrant signed by a judge. Despite Trump\u2019s promise to target \u2018the worst of the worst,\u2019 this administration is going after young people brought to this country as children through no fault of their own.\u201d<\/p>\n

In an interview with 13 News on Saturday, May 23, Grijalva said she\u2019s calling for an investigation into the ICE agents involved and plan to push for legislation to ensure something like this can\u2019t happen again.<\/p>\n

\u201cIt\u2019s a push for me as an elected official in the federal government to codify DACA and all of those recipients into law and give them a pathway to citizenship,\u201d Grijalva said.<\/p>\n

The DACA program was designed to protect those brought to the U.S. illegally as children from deportation. DACA has been in legal limbo in recent years after the fifth circuit of the U.S. Court of Appeals ruled it unlawful in 2025.<\/p>\n

According to Toledo\u2019s attorney, that has slowed down the application renewal process and prevented new DACA applications from being processed or approved.<\/p>\n

Codifying DACA would make the policy federal regulation, preventing any president from changing or revoking it.<\/p>\n

\u201cBecause it\u2019s an executive sort of order, the Executive can change their minds, and it leaves people like Karla in this sort of limbo,\u201d Grijalva said.<\/p>\n

Grijalva says there are thousands of DACA recipients in Arizona who she believes deserve clarity about their legal status, which is why she says she\u2019ll continue to advocate for DACA\u2019s protection to ensure that happens.<\/p>\n

\u201cWe need to make sure that that continues to mean something regardless of who is in the White House,\u201d Grijalva said.<\/p>\n

Toledo\u2019s mother, Veronica, stood behind the family representative and lawyer throughout the press conference, speaking about her daughter through tears.<\/p>\n

In Spanish, she said, \u201cIt\u2019s important and unjust that my daughter was arrested. My daughter needs to be free because she\u2019s a great person who\u2019s worked very hard in the community.\u201d<\/p>\n

IMMIGRATION ATTORNEY WEIGHS IN<\/b><\/h3>\n

Goldman had previously told 13 News that Toledo\u2019s DACA status was up to date, but he believes ICE may have justified her arrest due to trips she made out of the country. <\/p>\n

He said she was issued a travel permit to leave the U.S., called advance parole, but said there aren\u2019t clear requirements about how many times it can be used.<\/p>\n

\u201cApparently, that was their basis for detaining her: that she used it more than one time,\u201d Goldman said on Tuesday.<\/p>\n

He said the backlog of DACA renewals also makes it hard to determine what is and isn\u2019t allowed for DACA recipients.<\/p>\n

\u201cPart of the problem is that she filed for DACA as an extension, and the U.S. immigration service has been sitting on it for months, like many others, and it\u2019s forcing people to ultimately not be in that DACA-protected status,\u201d Goldman said.<\/p>\n

TOLEDO\u2019S ARREST & REACTION<\/b><\/h3>\n

Rep. Adelita Grijalva said she visited Toledo at an ICE holding facility in Tucson after her arrest on Monday.<\/p>\n

\u201cI just got done visiting with Karla Toledo at an ICE facility in Tucson,\u201d Grijalva said in a release Monday. \u201cKarla is a DACA recipient with legal status in this country who is a beloved member of our community that serves on local boards and volunteers her time helping others.\u201d<\/p>\n

Grijalva claimed agents entered Toledo\u2019s home without a warrant and said she is calling on ICE to release Toledo immediately. She said her office left paperwork for Toledo, who is physically OK, to fill out.<\/p>\n

\u201cICE\u2019s blatant disregard for the rule of law and due process is outrageous and completely out of line,\u201d she said. \u201cWe live in a country where everyone has constitutional rights, no matter how hard ICE tries to trample on them. Karla must be released immediately, and ICE must stop terrorizing our communities.\u201d<\/p>\n

Several groups, including Scholarships A-Z<\/b><\/u><\/i> and the Party of Socialism & Liberation,<\/b><\/u><\/i> hosted an emergency protest Monday demanding the release of Toledo, whom they called an anti-ICE activist. It was held at the ICE field office at 6431 South Country Club Road.<\/p>\n

PSL Tucson claimed that ICE said Toldeo was \u201cdetained based on a legal requirement that doesn\u2019t even exist.\u201d<\/p>\n

Scholarships A-Z Executive Director Carolina Silva told 13 News she has known Toledo for five years. She said Toledo has lived in the U.S. since she was only 1 year old and has become a member of the Tucson community.<\/p>\n

\u201cShe\u2019s an influencer, she\u2019s a caretaker for her younger sister, she\u2019s worked at various nonprofits, always helping the community,\u201d Silva said.<\/p>\n

Silva said Toledo has no criminal history, but 13 News has not been able to confirm that.<\/p>\n

\u201cThis is just really upsetting. Karla has lived here her whole life and should have this protection, so I think it\u2019s really concerning to see that that protection isn\u2019t being taken into account; it\u2019s being violated, and she was, right, forcefully removed without reason,\u201d Silva said.<\/p>\n
