PHOENIX (AZFamily)<\/b> \u2014 A man convicted in the 2015 sexual assault and murder of Scottsdale resident Allison Feldman was sentenced Thursday morning on the lesser charges in the case.<\/p>\n

Ian Mitcham was sentenced to 10.5 years in prison for sexual assault and second-degree burglary. <\/p>\n

Maricopa County Superior Court Judge Sunita A. Cairo ordered the sentences to be served consecutively, saying the crimes were separate and distinct offenses.<\/p>\n

Mitcham received 3.5 years for burglary and seven years for sexual assault. He was also given credit for 2,328 days already served and must register as a sex offender.<\/p>\n

The sentencing does not include Mitcham\u2019s first-degree murder conviction. He will be sentenced for Feldman\u2019s murder at a later date.<\/p>\n

The murder sentencing phase ended in a mistrial Wednesday after jurors said they were deadlocked on whether Mitcham should receive the death penalty or life in prison. The judge sent jurors back to continue deliberating, but they still could not reach a unanimous decision, so the jury was dismissed.<\/p>\n

A day earlier, jurors were told to restart deliberations after one juror made an unknown comment. That juror was removed and replaced with an alternate before deliberations resumed Wednesday morning.<\/p>\n

His next appearance is scheduled for July 29. <\/p>\n

Mitcham\u2019s conviction<\/h2>\n

Closing arguments were completed last week in the sentencing phase of Mitcham\u2019s trial.<\/p>\n

On April 9, Mitcham was convicted of murdering and sexually assaulting Feldman, whose death remained unsolved for years before investigators said DNA evidence connected him to the crime.<\/p>\n

Police and Feldman\u2019s family said there is no known connection between Feldman and Mitcham and no known motive. Prosecutors argued the attack was a crime of opportunity, tied to Mitcham\u2019s life circumstances at the time.<\/p>\n

During the trial, prosecutors described Mitcham as down on his luck, angry, drinking too much and feeling as though he had nothing left to lose. They said DNA evidence tied him to the scene.<\/p>\n

Mitcham and his defense attorney maintain he is innocent and argue that investigators failed to fully pursue another possible suspect.<\/p>\n

Joshua Kolsrud, a criminal defense attorney not affiliated with the case, said remorse, or lack thereof, could play a role in sentencing.<\/p>\n

\u201cIf I were Ian Mitcham\u2019s attorney, I would certainly have my client show remorse to the victim\u2019s family, to the court, the prosecutor,\u201d Kolsrud said. \u201cAnd you can show remorse without admitting guilt in the case. Because, again, you want to preserve the actual innocence argument later on when this case is appealed.\u201d<\/p>\n

DNA evidence and legal precedent<\/h2>\n

Investigators found partial DNA at the scene in 2015, but there was no direct match to anyone in the system. The case went cold until 2018, when Scottsdale police ran a familial DNA test that identified an Arizona prison inmate as a close relative to the murder suspect.<\/p>\n

The trail led to his brother, Ian Mitcham, whose blood was already in the Scottsdale police vault from a DUI investigation.<\/p>\n

A judge ruled that DUI DNA should not be used because it was not destroyed three months after his arrest, violating his rights. The prosecution appealed, and the case went to the Arizona Supreme Court.<\/p>\n

Justices decided that keeping the evidence violated Mitcham\u2019s Fourth Amendment rights. But the justices said police would have discovered the DNA evidence through other lawful means untainted by the illegal search after Mitcham was arrested for different crimes.<\/p>\n

Kolsrud said that precedent will be used in future cases.<\/p>\n

\u201cThis is an important case for precedential reasons, because it\u2019s the first case in Arizona where familial DNA led to the apprehension and charges of a defendant, a cold case,\u201d Kolsrud said. \u201cAnd now, you know, both defense attorneys and prosecutors alike are going to have a roadmap as to what the admissible evidence is in similar situations.\u201d<\/p>\n
