BEVERLY, W.Va. (WDTV/Gray News) – Two parents are facing charges after a witness reported finding an 11-year-old restrained with zip ties inside a bathroom at the family’s residence, according to West Virginia State Police.

Manual Ortiz Jr., 69, and Licha Ortiz, 54, both of Beverly, are each charged with child abuse creating risk of death and conspiracy, troopers said.
According to a criminal complaint, a witness told police she saw the child inside a bathroom in a garage where the family lives, with her hands behind her back and her ankles restrained with zip ties. The witness also reported the edges of the bathroom door appeared to be sealed with spray foam and that Licha Ortiz was speaking to the child through a crack in the door.
The witness said she used a pry bar or long screwdriver to remove the foam and open the door, where she saw the child restrained, the complaint states.
When the witness’s boyfriend commented to Manual Ortiz, he replied, “It makes you uncomfortable,” according to official records.

Troopers and officers with the Elkins Police Department later executed a search warrant at the residence and reported seeing large amounts of trash and belongings scattered throughout.
Police said the child had ligature marks on her wrists and ankles, and her feet appeared swollen and red. Investigators also reported finding spray foam along the edges of the bathroom door and a cut zip tie on the floor behind the toilet.
Authorities also documented writing on the bathroom walls that said, “they love my brother but not me…no one on my side just me.”
Both parents are in the Tygart Valley Regional Jail with cash-only bonds set at $150,000 each.
